The Synod of Bishops on the Family. Some canonical questions
Keywords:
Canonical family law, admission to marriage, identification contractsacrament, doubtful validity, matrimonial nullity process.Abstract
Pope Francis called an Extraordinary General Assembly of the Synod of Bishops on topics related to the Christian family and the challenges of evangelization in these early years of the 21st Century. On the occasion of its celebration, the author points out the absence of a real family law on the Code of Canon Law, as well as the right-duty of Christian families to evangelization. He offers some reflections on several canonical questions that may help to solve some difficulties related to failed marriages, such as the preparation and admission to canonical celebration of marriage, the identification contract-sacrament, the presumption of c.1060, the proof of matrimonial nullity and the need to increase procedural celerity in the matrimonial nullity cases, among others.
