Abstract

There are several arguments to consider that the dismissal from a IR of cc. 694-696 has not the treatment of a canonical penalty in the CIC, though one could argue some reasons to the contrary. This approach, that can be sustained in elements of substantive and procedural in nature, would deserve special attention in an eventual claim to integrate this expulsion in the Law of the Church as a canonical penalty.

Author Biography

José Luis Sánchez-Girón Renedo, S.J., Universidad Pontificia Comillas

Licenciado (1999) y Doctor (2006) en Derecho Canónico por la Pontificia Università Gregoriana (Roma). Anteriormente estudió en la Universidad Pontificia Comillas (Madrid) donde obtuvo las licenciaturas en Derecho, Ciencias Empresariales y Estudios Eclesiásticos (Bachiller en Teología) en 1984, 1985 y 1997, respectivamente. En el año1999 comenzó a colaborar en labores de docencia en la Facultad de Derecho Canónico de la Universidad Pontificia Comillas, donde enseña regularmente desde el 2004. Actualmente imparte los cursos Fundamentos teológicos del Derecho Canónico, Sanciones de la Iglesia y proceso penal, Constitución Jerárquica de la Iglesia y Curia diocesana y Parroquia. Es profesor propio adjunto y Jefe de Estudios de la Facultad de derecho Canónico. También es juez ad casum en el Tribunal Eclesiástico Metropolitano de Madrid.
