This study aims to examine the Germany insolvency system and the European legislation on insolvency. As far as German legislation is concerned, the author focuses on the opening proceedings and open insolvency proceedings. As regards European law, the study describes how the effects of companies’ activities are growing across Europe and in an international context. The current legislation provides regulations in which the emphasis falls on finding a solution to the conflicts between different legal systems and those concerning authority among the various courts involved.
