La transnacionalización del estado en el proceso de constitución de una política común europea de control de la inmigración

Como respuesta regional a la transnacionalización, la integración europea ha conducido a la creación de instituciones supranacionales cuyas funciones habían sido elementos fundamentales del Estado hasta entonces. El desarrollo que se puede observar desde 1999 ha llevado a políticas europeas de control migratorio que colocan a los argumentos clásicos de la teoría del Estado ante nuevos desafíos. Una de las razones es que tal desarrollo implica la formación de un territorio que sobrepasa los límites de los territorios nacionales, implicando un régimen de regularización transnacional de la población así como desplazamientos del monopolio del poder y de la ciudadanía. Ante este trasfondonuestro objetivo es analizar empíricamente ese nuevo conjunto deinstituciones que se viene formando dentro de este proceso. Partiendo de la premisa de que la forma concreta de lo político siemprees el resultado de conflictos sociales, las tesis que defendemos son las siguientes: La unión del Estado nacional y territorial está en proceso de desintegración, mientras que los aparatos del Estado seestán recomponiendo, junto a las nuevas instituciones europeas recién creadas, en un conjunto reterritorializado y diferenciado de aparatos de control, que va a gobernar a la población a través de la constitución de zonas de derechos legales estratificados.Descargas
