Capabilities, Health and Systems: Rethinking Health as Part of Distributive Justice

This paper attempt to explain health conception and the conformation of healthcare by the distributive justice theories and the access to the development of capabilities as the base of just healthcare structure. As well, it attends topics about first level of attention in healthcare as founding of development of capabilities and access to functional diversity. Is, for this, a redefinition of bioethical contractualism, applied at the structure as basis of justice and the development of capabilities.
