The protection to the family: from the Universal Declaration of Human Rights until the Constitutional Texts of European Union

Abstract

The present study puts of relief that the protection to the family who proclaims the Universal Declaration of Human rights recognized in article 16.3 like «the natural and fundamental element of the society», supposes that the States,and the different societies, have to establish mechanisms by which it equips tothis institution with a special protection and shelter to all his members. Some European countries have including in their constitutional texts rules dedicated to guarantee the social rights, demanding therefore a greater responsibility to the powers public in their political action. Within this group of rights references to the family are made in some constitutional texts. These cases are analyzed seeingas it is the constitutional reach that is granted to the protection of the familiar institution.
