The final problem: the distinction between clauses limiting and bounding in the insurance contract

Abstract

The paper studies the problems concerning the distinction on the Spanish Insurance Contract Act about lesive, limitative and delimitative conditions, being these categories non equivalent to the distinction used on the modern Consumers Protection Law between abusive and non-abusive conditions. Some reasons to abandon such old distinction and to unify the insurance contract treatment with other consumers’contracts are given, analyzing the doctrine and jurisprudence’s considerations about the practical distinction between limitative and delimitative conditions of the insurance contract, as well as the demanded requirements for the validity of thelimitative conditions.
