Abstract

This article criticizes the lack of intervention and reach of the Insolvency Act in the criminal field. The current criminal law is assessed as regards cases of insolvency. The Insolvency Act was conceived to cover all matters pertaining to cases of insolvency, but coverage is poor when such cases of insolvency involve criminal offences. The regulation on this type of insolvency in Criminal Law show the lacunae still present in the new Insolvency Act.
