The rights of foreigners in the area of Council of Europe: special reference to the jurisprudence of human rights court.
Abstract
This paper presents the criteria which, in accordance with the European Convention on Human Rights and the legal precedents set by the Court in Strasbourg, must be followed when the Spanish legislator develops norms regulating migratory policy and the rights of foreigners. The obligation to abide by the European Convention and Courts is stipulated in Sections 13, 10.2 y 96 of the Spanish Constitution.
