Abstract

In a time of great confusion about how to deal with children with gender dysphoria, this text aims to contribute to a calm reflection on the rights of these children from the perspective of the 1989 Convention on the Rights of the Child. To look for the best interests of the child in each decision to be taken, and therefore to evaluate the different rights involved, to take into account the legal criteria that facilitate that evaluation and to weigh the elements that are involved in the situation is not only convenient but an imperative that arises from the conventional text.

Profesora de Derecho internacional privado, Derecho de la nacionalidad y la extranjería, Derecho Civil Consular y Derecho de las Relaciones Familiares y del Menor. Pertenece a un grupo de investigación de Derecho y Menores y ha dirigido la Cátedra Santander de Derecho y Menores. Sus publicaciones recientes abordan temas como el interés superior del niño, los derechos de los niños, la situación de los menores extranjeros no acompañados y el sistema de protección de menores.
