Legislative barriers to development of mediation in social jurisdiction

Attempts to develop mediation in the legal system and within the courts should emphasized speed, low cost, increased party participation, simplification and more tailored and creative solutions. However, the labor law-makers are still anchored in a particular understanding of mediation and its values, blocking in practice the adequate development of mediation connected to labor courts. To meet this challenge, recognition and constant attention should be given to all the specific social and human values treating them as goals in their own right and not just by-products of settlement.
