Considerations and limitations on the normative foundations of an intercultural human rights theory

Boaventura de Sousa Santos’ human rights intercultural conception aims to question their current hegemonic universality due to the diverse historic forms of domination they have been aligned with and recognize other alternative grammars of human dignity. However, accepting this diversity erodes human rights’ universal moral foundation and their emancipatory orientation. This article will seek in Rainer Forst’s basic right to justification a possible normative basis that could orient struggles for human dignity in this emancipatory sense and, at the same time, respect its plurality and different needs. Nevertheless, this sets some difficulties on Forst’s rationalist dimension of his proposal and the limitations of its critical reach on the existing power relations.
