The superior who establishes the penalty: a critical evaluation of cc. 1333 §3.1 and 1338 §1 from an exegetical approach

Canons 1333 §3.1 and 1338 §1 mention the «Superior who establishes the penalty». In Book VI «establishing a penalty» (poenam constituere) means an action carried by the law more than the Superior. For this reason the reading of both canons may appear confusing and in contradiction with some other norms. A detailed analysis allows suggesting another reading that could have been better. It is also possible to discuss if there would be another substantial approach to this canons.
