Mercy and failed marriages: some considerations facing a possible juridical and pastoral rethink

Abstract

Having the Jubilee of Mercy as a main reference, and facing the challenges posed by the Synod on the Family, this paper attempts to present the canonical solutions in case of failed marriages and the possible new ways that can be considered from the point of view of canon law. Regarding the marriage nullity cases, I expound the deficiencies I perceive in the current praxis, and regarding canonical dissolutions, the possibility of delving into the full meaning of sacramentality and consummation. From this, I propose to extend the canonical solutions in favor of the faith and the salus animarum.

Author Biography

Rufino Callejo de Paz, Universidad Pontificia Comillas

El profesor Rufino Callejo de Paz estudió en la Universidad de Valladolid, donde se licenció en Derecho. A partir de ahí, y dentro de la Orden de Predicadores, en la que profesó el año 1989, estudió la diplomatura de Filosofía y pedagogía en el Instituto de Filosofía de Valladolid, y acabó sus estudios eclesiásticos con el Bachiller en Teología en la Universidad Pontificia de Salamanca en 1995. En la Universidad Pontificia Comillas se licenció y doctoró en Derecho Canónico, impartiendo clases en dicha universidad desde el año 2000 en las Facultades de Derecho Canónico, Derecho - ICADE y Teología.
