Abstract

The m.p. As a loving mother provides the dismissal of the diocesan bishop for negligence in performing his pastoral office. The Code of Canon Law contains norms regarding the loss of an office. Among them, c. 1389 §2, and even cc. 1740-1747, provide relevant elements for an evaluation of this m.p. of Pope Francis, which seems to relegate the penal proceeding in this cases when they regard the diocesan bishop, in exchange for a harder handling of them.

Author Biography

José Luis Sánchez-Girón Renedo S.J., Universidad Pontificia Comillas

Licenciado (1999) y Doctor (2006) en Derecho Canónico por la Pontificia Università Gregoriana (Roma). Anteriormente estudió en la Universidad Pontificia Comillas (Madrid) donde obtuvo las licenciaturas en Derecho, Ciencias Empresariales y Estudios Eclesiásticos (Bachiller en Teología) en 1984, 1985 y 1997, respectivamente. En el año1999 comenzó a colaborar en labores de docencia en la Facultad de Derecho Canónico de la Universidad Pontificia Comillas, donde enseña regularmente desde el 2004. Actualmente imparte los cursos Fundamentos teológicos del Derecho Canónico, Sanciones de la Iglesia y proceso penal, Constitución Jerárquica de la Iglesia y Curia diocesana y Parroquia. Es profesor propio adjunto y Jefe de Estudios de la Facultad de derecho Canónico. También es juez ad casum en el Tribunal Eclesiástico Metropolitano de Madrid.
