Abstract

The phases of the instruction are stated and analyzed, as well as the bishop’s decision, on the causes of nullity of marriage in briefer process. Several means of proof are suggested to be examined during the instruction session, according to different grounds of nullity mentioned in the article 14§1 on the Procedural Rules. It is also stated that the bishop with the assistance of the instructor and the assessor must sign the judgment. Finally, data from the Spanish ecclesiastical courts about the recent practice of this new process are provided.

Cristina Guzmán Pérez, Universidad Pontificia Comillas

La profesora Cristina Guzmán Pérez estudió ICADE (E-1) licenciándose en Derecho por la Universidad de Deusto y graduándose en Ciencias Empresariales por ICADE en 1979. Se doctoró en Derecho en la Facultad de Derecho de la Universidad Pontificia Comillas en 1995, con su tesis doctoral La simulación del consentimiento matrimonial. Aportación de los canonistas españoles 1917-1983, publicada por la Ed. Colex. Madrid 1999. Es licenciada en Derecho Canónico por la Universidad Pontificia Comillas desde el año 1993. En el año 1983 comenzó su docencia en la Facultad de Derecho de la Universidad Pontificia Comillas. Ha enseñado Derecho Canónico y Derecho Eclesiástico del Estado en Grado y Postgrado. También ha impartido la asignatura optativa de Crisis Matrimoniales Civiles y Canónicas. Actualmente imparte Derecho Eclesiástico del Estado y Derecho matrimonial canónico en la Facultad de Derecho, así como un Seminario de Derecho Eclesiástico en la Facultad de Derecho Canónico. También ha colaborado con docencia en los cursos de especialización en violencia de género en el Instituto de Familia e imparte en la actualidad la asignatura de Bases jurídicas para la intervención con familias en el Máster de Terapia familiar sistémica. Actualmente es Profesora Propia Agregada en la Universidad Pontificia Comillas y Directora del Departamento de Derecho Canónico y Derecho Eclesiástico del Estado en la Facultad de Derecho Canónico. Abogada en ejercicio de causas civiles y canónicas desde 1980.
