Instruction and decision in briefer process. Practice of ecclesiastical courts in Spain

The phases of the instruction are stated and analyzed, as well as the bishop’s decision, on the causes of nullity of marriage in briefer process. Several means of proof are suggested to be examined during the instruction session, according to different grounds of nullity mentioned in the article 14§1 on the Procedural Rules. It is also stated that the bishop with the assistance of the instructor and the assessor must sign the judgment. Finally, data from the Spanish ecclesiastical courts about the recent practice of this new process are provided.
