The Instruction «Dignitas Connubii» and its application in the canonical process of matrimonial nullity

The Instruction Dignitas Connubii —published several months ago by the Pontifical Council for Legislative Texts— contains the norms to be observed at ecclesiastical tribunals in matrimonial proceedings. This Instruction develops the norms of the Code of Canon Law, and presents in a unified manner the whole canonical process of matrimonial nullity, and integrates the juridical developments that occurred in the last 20 years, since the promulgation of the Code. The Instruction attempts to improve the administration of justice throughout the Church and to help tribunals handle their work better. However, the interpretation and application of this Instruction at ecclesiastical courts can also cause some difficulties that need to be clarified. This article analyses the text of the Instruction and underlines what is new with regard to the canons of the Code, attempting to offer interpretative criteria that facilitate the application of the new norms.Downloads
