Some notes on administrative processes and appeals

Both in the administrative process and in the right to appeal to the hierarchy, the believer’s inalienable right to take umbrage and to receive a reasoned and reasonable answer from the Administration should be granted. With this in mind, this article reviews the post-conciliar situation, the proposals at the time of the Council, and the various events leading to the finally approved legislation. The current regulations and their implementation are analysed from the initial stages, where an appeal is possible, until the adversarial process by the Apostolic Signature. Finally, some reflections are made about the need of assuming fundamental rights in administrative process.Downloads
