Abstract

It deals with a decree that ratifies a sentence of marriage nullity in the First Instance. The point on which it is based is the incapacity of assuming the essential obligations of matrimony, by psychic anomaly (c.1095, 3.º). The legal fundamentals are presented as well as the facts to which they are applied.
